Karnataka marches ahead on 12th Dec Strike preparation.

 The preparation for 12th December strike is on the way in Karnataka State with leaders of  Confederation AG's and NFPE visiting the state.

The Karnataka  COC Meeting  was held on 8th August   2012 at Income  Tax Office  Bangalore under the chairmanship  of Com Seethalakshmi  Vice President COC . It was decided to prepare for agitational program as proposed by Confederation.

The COC Meeting was conducted on 18th August  2012 at RMS office which was addressed by Com M.Krishnan Secretary General of NFPE which was attended by leaders of P-3, P-4, RMS, GDS, AG's , Central Excise, Postal Accounts, Ground Water, Survey of India, GSI, P& T audit,  CGHS etc. In which more than 150 members participated. 

On 19th August at Gopalpura  Hassan district which was addressed by Com M.Krishnan Secretary General of NFPE, In which more than 200 members participated. & Com. Prasad, General secretary, COC, Karnataka explained briefly about the efforts of Confederation to take the issues of GDS problems along with regular employees issues and also explained why 12-12-12 one day token strike is inevitable to achieve our legitimate demands. Representatives of P3, P4, GDS from Mysore, Mangalore, Kodagu, Hassan, Gulbarga, Raichur, Bangalore, Bellary, Udupi, Koppal, Chikmagalur, etc., are participated, Delegates, Circle Office bearers of GDS NFPE  participated in the meeting.

The COC Meeting was conducted on 27th August  2012 at AG's  office which was addressed by Com M.S.Raja  Secretary General of AG;s and also Secretary of Confederation of CGE   which was attended by leaders of  RMS,  AG's ,  Postal Accounts, Ground Water, Survey of India,  P& T audit,  CGHS etc. This was a leaders meeting.

 A few more meetings are taking place in September , already a two page pamplet in dual language is circulated, With these meetings the preparation for 12th Dec 2012 strike has started.

STEPS TO IMPROVE PERFORMANCE OF CGHS


Health & Family Welfare Minister Shri.Ghulam Nabi Azad replied in Lok Sabha on 17.8.2012 to the question of 'what action taken by the Government, whether complaints have been received about the dissatisfaction of a large number of Central Government Employees with the services provided by the Government under the Central Government Health Scheme'.

PERFORMANCE OF CGHS

While CGHS endeavors to provide best possible health care facilities to the large number of beneficiaries consulting / visiting CGHS Wellness Centres (approx. 1.2 Crore during the last one year), some complaints are received about unsatisfactory services. 

The dissatisfaction relates to shortage of doctors and other manpower resulting in waiting period before consulting doctors, issue of medicines, delay in settlement of medical claims of pensioners, issue of medicines of specific brand, reimbursement at CGHS rates for the treatment taken from unrecognized hospitals, overcharging by empanelled hospitals, opening of new dispensaries, etc. 

Government has been receiving increased budgetary support over the last few years to take care of CGHS beneficiaries. 

Government has undertaken several steps to improve the functioning of CGHS. These include: 
  • Computerization to improve better inventory management and availability of medicines at CGHS Wellness Centres. Based on computer data, 272 commonly indented medicines are procured from manufacturers at discounted rates and make them available at Wellness Centres. 
  • Portability of CGHS cards at any dispensary all over the country. 
  • Issue of medicines for three months in cases of chronic illnesses. 
  • Appointment of Medical officers on contract basis as an interim measure to tide over shortage of doctors. 
  • Receipt of medical claims of pensioners at Dispensary level and proper verification of documents by CMO i/c to ensure that all required documents are submitted. 
  • Enhancement of financial powers of Addl. Directors upto Rs.5 Lakhs for speedy settlement of medical claims of pensioners. 
  • Regular meetings undertaken by Addl. Directors with CMOs i/c to ensure smooth functioning of Wellness Centres for better delivery of services. 
  • Reimbursement from two sources – i.e., from CGHS as well as medical insurance in respect of beneficiaries holding mediclaim policies. 
  • Formation of Standing Technical Committees for examination of requests for full reimbursement. 
  • Settlement of hospital bills of empanelled hospitals and diagnostic centres through UTI-ITSL for early settlement of claims to ensure that the empanelled hospitals provide credit facility to pensioners , etc., 
  • Pensioner CGHS beneficiaries residing in non-CGHS areas are permitted to avail IPD and follow up treatment from CS (MA)/ ECHS empanelled hospitals with prior permission from CGHS.

Contract Labour Wages


Comrade,

 The  Honorable Union Labour & Employment Minister Shri Mallikarjun Kharge gave this information in a written reply  in  Rajya Sabha.

In cases where  the contract worker perform  the same or similar kind of work as the workmen directly employed  by the principal employer of the establishment, the wage rates, holidays , hours of work and other conditions of service  shall be the same as applicable to the workmen directly employed by the principal employer doing the same or similar kind of work.    The liability to ensure payment of wages and other benefits is primarily that of the contractor and, in case of default, that of the principal employer. 

In that case the contract labour working in the Central Government offices who are actually performing the duties that of the regular workers/ employees example such as MTS, Driving a vehicle, peon jobs, safiwala. Postal jobs performed by GDS workers should be provided with the wage rates, holidays , hours of work and other conditions of service  shall be the same as applicable to the workmen directly employed by the principal employer (Central Government ) doing the same or similar kind of work.

Prepare for General Strike on 12 December 2012

Dear Comrades
Prepare for General Strike on 12 December 2012
The Rally of Central Government employees from all over the country participating in ‘March To Parliament’ under  the banner of Confederation of CGEs on 26 July 2012 decided to go on one day All India Strike on 12 December 2012 on following demands:

1)Revision of wage with effect from. 1.01.2011 & The Government must set up the 7th CPC immediately.  
In Central Government undertaking, Nationalised Banks and Insurance wage revision takes place once in every five years.   The retail prices of those commodities which go into the making of minimum wages have risen by about 160% from 1.1.2006 to 1.1. 2011, whereas the D.A. compensation in the case of Central Government employees on that date had been just 51%,  due to faulty DA formula.
The 6th Central Pay Commission applied a multiplication factor of 1.86 for arriving at the revised pay structure to Group C and D Employees , in the case of Group A Officers, the factor was ranging from 2.36 to 3 times. apply uniform fitment formula for all.
The National Anomaly Committee met 4-5 times, it could not settle any major issues. The MACP, introduced by the Government in replacement of the ACP Scheme already in vogue has not gone to improve the career prospects of the employees due to various untenable stipulations made in the order by the DOPT.
The Grameen Dak Sewaks  should be included in the  7th Central Pay Commission wage review .
The rupee value has gone down from past six years.


2)Merger of DA with pay:
 The DA has crossed 72 % as on 1st July 2012, The actual rise in prices are more than 160%, The DA should be merged with Basic pay to protect the employees interest. Today the house rent in market has increased by more than 200% from past six years where as we are compensated only by just  12%.  Only a few allowances are included for 25% increase, If DA is merged then 50% benefit will accrue for all allowances. It is, therefore, necessary that the Government takes steps to merge 50% of DA with pay for all purposes to compensate the erosion of the real value of wages of the Central Government employees including the Grameen Dak Sewaks.

 3)Compassionate appointments.
 Discrimination between Railways and other Central Govt. employees should be removed, remove ceiling of 5% and assure Govt. jobs for all.

4)Downsizing, outsourcing, contractorisation etc.
               Due to the situation that  came into being because of the 2001 directive of the Government, as explained in the preceding paragraphs and due to the pursuance of the neo- liberal economic policies, many departments had to resort to outsourcing of its functions.  Some departments were virtually closed down and a few others were privatized or contractorised.   The large scale outsourcing and contractorisation of functions had a telling effect on the efficacy of the Government departments.  The delivery system was adversely affected and the public at large suffered due to the inordinate delay it caused in getting the service from the Government departments.  The financial outlay for outsourcing of functions of each department increased enormously over the years.  The quality of work suffered.  In order to ensure that the people do get a better and efficient service from the Government departments and to raise the image of the Government in the eyes of the common people, it is necessary that the present scheme of outsourcing and contractorisation of essential  functions of the Government must be abandoned.

5)Career progression:
    The discontent amongst the employees in the matter is of high magnitude today.  It is, therefore, necessary that every Department is asked to undertake to bring about a cadre composition and recruitment pattern in such a manner that an employee once recruited is to have five  hierarchical promotions in his career as is presently the position in the All India Services and in the organized Group A services.

6)Scrap the New Pension Scheme 

7) Proper functioning of the JCM  and implementation of the arbitration award.

8) Remove the ban on recruitment and creation of posts

9) Stop price rise and strengthen PDS.

10(a) Regularization of daily rated workers.
(b). Absorption of GDS as regular postal employees

11. Introduction of PLB and removal of ceiling limit

12. Revising OTA and Night Duty allowance rates on par with Railways

13. Implement Arbitration Awards.

14.  Victimization Vacate All Trade Union victimization.

15. Make Right to strike a fundamental right

Educate the membership about above demands and prepare them for strike to achieve our legitimate demands.

COC Meeting Minutes


The Karnataka  COC Meeting  was held on 8th August   2012 at Income  Tax Office  Bangalore under the chairmanship  of Com Seethalakshmi  Vice President COC .

The following  decisions was taken.

a) Com Prasad thanked the affiliates of the COC in conducting the COC Conventions at  Bangalore at CITY RMS Office  on 15th June 2012  which was addressed  by  Com K.V.Sridharan General Secretary AIPEU Group 'C'  and other trade union leaders and also  the program was held at districts as follows.
1) Mysore at Head Post Office on 16th June 2012
2) Hubli at Head Post Office on 29th June 2012.
3) Mangalore at Head Post Office on 18th June 2012
b) It was decided to educate the employees regarding 15 charter of demands. Posters/ Pamplets  will be prepared and distributed each and all  affiliates are directed to hold meetings in their offices to educate the workers at grass root level. 

c)The participation of  members for the March to Parliament on 26th July 2012 was satisfactory. With participation from NFPE. ITEF,  P&T Audit, Ground Water, GDS etc  Comrades from Bangalore, Mysore, Hassan, Mangalore,  Raichur, Gulbarga etc. participated in the rally.

d) The further programs of  Confederation from September onwards will be carried out in Bangalore and all Districts of Karnataka 

e) The COC Meeting will be held on 18th August 2012 at 5pm at  CITY RMS office Bangalore which will be addressed by Com Krishnan Secretary General NFPE and General Secretary COC Kerala. All Affiliates are requested to mobilize their rank and file for this meeting

Issue of Individual CGHS Plastic Cards to all (Retired and Existing) beneficiaries

It has been decided by the office of PCDA Bangalore, to Issue Individual Plastic Card to all CGHS beneficiaries from 1st August 2012 by CGHS Koramangala, Bangalore. In this connection, the guidelines on Issue of Individual Plastic Cards to each CGHS beneficiary (serving and retired) are revised as follows:

1) CGHS Cards shall be issued only to the eligible Central Government Employees whose place of residence is situated within the coverage area of CGHS.

2) Requisition for CGHS shall be prepared in duplicate in Form “A”.

3) Requisitions for CGHS Cards shall be accompanied by two copies of recent 3X5 cm size individual photographs of all the family members of the government employee. One set of the photograph shall be signed on the back by the concerned beneficiary & enclosed with the application form.

4) Requisitions shall be sent along with two copies of the challan as on Form ‘C’ duly filled in.

5) On the occurrence of death, CGHS Cards issued to the government employee shall be withdrawn for cancellation.

6) In case of change in entitlement for CGHS facilities, the Government employee shall enclose the CGHS Card(s) with the application for Issuing new card(s) with the revised entitlement.

7) In case of mutilation, the mutilated card shall be enclosed with the application along with the challan in token of payment of the prescribed charges for issuing a new card.

8) Duplicate Cards may be issued on payment of prescribed fee with details of lost / misplaced cards.

9) The plastic cards issued by CGHS shall be valid for a period of five years from the date of issue. The validity period shall also be indicated on the card.

MACP issues


The joint Committee set up by the National Anomaly Committee to consider the MACP related issues met on 27th July, 2012.  The Staff Side was represented at the meeting by the following comrades:

The report prepared by the sub-committee after three rounds of discussions was reviewed at the meeting.  The points that came up for discussion and the decisions taken are as under:

Grant of MACP in the promotional hierarchy:  The Staff Side pointed out that the ACP which was in vogue till the advent of MACP had been on promotional hierarchy.  In the name of improvement of the scheme, the Government cannot unilaterally change it, especially when the concerned employees do not consider it as advantageous.  They suggested that the employees must be allowed to retain the ACP for the first two promotions and for the third promotion MACP can be extended.  However, the Official Side said that it would not be possible to have any hybrid scheme.  In fact, they added that the 6th CPC had suggested for two career progressions only and that too on grade pay hierarchy.  The govt. had improved upon and therefore it was not possible for them to agree for the suggestion of the Staff Side.  They also stated that the reason for bringing about grade pay hierarchy was to bring about uniformity in the scheme across the Departments as the promotional hierarchy varies from one department to another.  They declined to consider the suggestion for promotional hierarchy based MACP.

The Staff Side then pointed that in the last meeting of the Committee, the Official Side taking into account the difficulties and disadvantages experienced by the employees in many departments which were presented by the Staff Side had agreed to consider department wise/cadre wise options.  The Staff Side further pointed out that the suggestion of the Official Side would not go to resolve the issue.  They said that option must be provide for each individual employee to choose either the ACP or MACP whichever is beneficial to him as is provided in the CCS(RP) Rules.  The unilateral withdrawal of a benefit from an employee is not permissible.  They also stated that the Official Side has not pointed out the difficulties in agreeing to this proposal.  After some discussions, the Official Side said that they would re-examine the issue of individual option and will come up with their considered view at the next meeting of the NAC.

Counting 50% of service of the Temporary status/casual labourers for the purpose of MACP:  In the light of the discussion at the meeting, the Official Side agreed to examine the matter.

Treatment of employees selected under LDCE Scheme and GDCE Scheme:  The Official Side agreed to issue orders on the same lines as has been issued under the ACP Scheme.  The Staff Side stated that wherever examination is the criterion for promotion/fast track promotion, the service rendered by such employees in the lower post must be ignored and such promotion should be treated as appointment and the promotion scheme to commence from the date of such appointment.  This was not agreed to by the official side on the plea that such appointments are against promotion quota and therefore, they are to be considered as promotion only.  The Staff Side them pointed out that this issue had been the subject matter of judicial consideration before the Tribunal and the Tribunal has given the decision in favour of the employees.  The Official Side wanted a copy of the judgement to react to this.

Date of effect of the Scheme:  The Staff Side pointed out that the date of effect of MACP Scheme must be from 1.1.2006.  The analogy of the 5th CPC has no application as ACP was introduced after discussion with the Staff Side on a later date.  Since the Government issued the orders of the 6th CPC and the acceptance of the MACP with modification almost simultaneously, it should have been made effective from 1.1.2006.  They also pointed out that the MACP is not an allowance to be made application from 1.9.2008.  The Official Side pointed out that the benefit emanating from the MACP i.e. the third promotion was applicable to all existing employees who were in service after 1.9.2008.  The Staff Side demanded that the benefit has been denied to those who retired between 1.1.2006 and 30.8.2008.  The Official Side agreed to consider application of the new MACP with effect from 1.1.2006 for those who retired/died between 1.1.2006 and 30.8.2008.

Financial up-gradation under MACP in the case of staff who join another unit/organization on request.  It was agreed at  the last meeting that the services rendered in another recruiting unit/organization will be taken into account for counting service for promotion under MACP.  The Staff Side however, pointed out that in many cases, the employees are compelled to seek reversion in order to be transferred to another recruiting unit.  In their case, the promotion so earned at the present recruiting unit and which have been foregone is being counted as one promotion under MACP.  The Official Side agreed to look into this matter and issue necessary clarificatory orders.

Stepping up of pay of senior incumbent with the junior as a consequence of ACP/MACP.  The Official Side stated that in the light of the judgments delivered in the matter they will have the case looked into and necessary instructions issued.  They also stated that certain instructions in the matter has already been issued, copy of which will be made available to the Staff Side.         

The bench mark question for promotion under MACP.  The Official Side agreed to issue a clarificatory order stating that if the promotion is on seniority cum fitness basis, MACP will also be on seniority cum fitness basis.

March to Parliament

Thousands of Employees marched on Parliament Street demanding Central Government to implement 15 charter of  demands including setting up 7th Pay Commission, DA merger and 5 career promotions in service.

The  march was attended by various organizations such as NPFE (RMS,  GDS  Postal ), ITEF, Ground Water, Audit &  Accounts Survey of India, CGHS , CPWD, Atomic Energy. Central Excise inspectors association, NSSO   Etc hundreds of  Comrades from Karnataka State participated in the rally. The comrades from Bangalore, Mangalore, Mysore, Hubli, Gulbarga, Raichur Hassan, Kolar districts participated in the March to Parliament. The COC Karnataka  red salutes all comrades  who have participated in the rally we hope the Government will yield to our demands.  .

Exemption of Salaried Employees from Requirement of Filing of Returns for Assessment Year 2012-13

Central Board of Direct Taxes (CBDT) vide its Notification No. 9/2012 dated 17th February, 2012 has exempted salaried employees from the requirement of filing the returns for assessment year 2012-13. The exemption is applicable only if all the following conditions are fulfilled:-


• Employee has earned only salary income and income from savings bank account and the annual interest earned from savings bank account is less than Rs. 10 thousand.

• The total Income of the employee does not exceed Rs. 5 Lakh (Total Income means Gross Total Income Less deductions under Chapter VIA).

• The Employee has reported his PAN to the employer.

• Employee has reported his income from interest on savings bank account to employer.

• Employee has received Form 16 from his employer.

• Total Tax Liability of employee has been paid off by employer by way of TDS and employer has deposited TDS with central government.

• Employee has no refund claim.

• Employee has received salary only from one employer.

• Employee has not received any Notice from Income Tax Department for filing of Income Tax return.

March to Parliament on 26th July 2012


All Comrades are directed to report at New Delhi on 26th morning at 10 am at  Jantar Mantar near to the intersection of Parliament Street, where the signal lights are installed. There will be a banner of the Confederation and COC Karnataka . They should intimate the  COC General Secretary Com P.S.Prasad mobile No 9480066620 accordingly.

  It has been decided to provide a badge to all the participants in the March.  The procession will commence at 11.30 AM to converge at the Parliament Street Police Station by 12 Noon.  The meeting will commence immediately thereafter.  A delegation will meet the Prime Minister either on the same day or on the day the appointment is given by the Prime Minister.

CGHS Bangalore has started issuing Individual Plastic Cards to the pensioners/ serving employees  with effect from 14.2.2012 for the new cardholders. It has been decided to change the existing cards of pensioners from old CGHS cards to the new individual Plastic Cards to each CGHS beneficiary with effect from 1.8.2012. All the pensioners who are holding old CGHS cards are required to submit duly filled application form in the prescribed format along with individual passport size photographs, contact phone number and address proof to the CMO Incharge of the concerned Wellness Centre. A specimen copy of application form is enclosed herewith. 

2. All CMO Incharges are requested to bring it to the notice of all the pensioners in their Wellness Center for changing old CGHS cards to individual Plastic Cards by putting up this in the Notice Board prominently. Sufficient applications may be kept at the Wellness Cent re to enable pensioners to submit the same before the due date. CMO Incharges are requested to collect the application form along with the documents from all the pensioners and serving employees  and send it to this office on 31.07.12 positively.
