Workmen or unions must be heard in labour disputes: SC


In labour disputes, the aggrieved workmen/unions should be compulsorily heard by the courts, before any order is passed, as otherwise, it would be violation of the "principles of natural justice," the Supreme Court has ruled.

"Labour statutes are meant for the benefit of the workmen. Hence, ordinarily in all cases under labour statutes the workmen, or at least some of them in a representative capacity, or the trade-union representing the workmen concerned must be made a party," a bench of Justices Markandeya Katju and Asok Kumar Ganguly observed.

The apex court passed the ruling while directing the Employees State Insurance (ESI) Court in Travancore to implead (hear) certain workmen who had been refused medical insurance benefits by the Fertilizers Chemicals Travancore Ltd to decide the eligibility of the workmen under the scheme.

Confederation Meeting Highlights

CONFEDERATION FINALISES CHARTER OF DEMANDS

The National Executive of Confederation met at New Delhi on 13th Sept 2009 under the presidentship of Com SK Vyas. The meeting after detailed deliberations finalised charter of demands and also decided to step up campaign amongst the rank and file of Central Government employees.
The Charter of Demands is given below:

(a) Reduce the price of all essential commodities.(b) Rescind the orders on outsourcing of Governmental functions and closure of offices
(c) Fill up all vacancies of Group D posts by regular recruitment and stop contracting out the Group D functions and employing daily rated/casual workers to carry out the Group D functions;
(d) Remove the condition imposed on employees who are recruited after 1.1.2004 to draw the 60% arrears (viz. the compulsory filing of application for registration to NPS)
(e) Rescind the decision to replace the CGHS and Medical facilities by Medical Insurance scheme without causing any discussion in this regard with the Staff Side.
(f) Restore the Departmental Council functioning in all Ministries/Departments and ensure that the meetings of the Councils are held once in every four months. Convene the meeting of the Anomaly committees to discuss and settle the issues.

ORGANISE HUMAN CHAINS ON 25TH NOVEMBER 2009

The Confederation National Executive called up on the affiliates and CoCs to mobilise the employees and workers to organise a Human Chain on 25th November 2009 preferably connecting two Central Govt. offices as is chosen by the concerned COCs. The human chain is to be organised to project the charter of demands listed in the earlier para and as detailed in the resolution given along with the enclosed Confederation Circular.
We endorse the decision of the Confederation and call upon every unit to take lead in the campaign to mobilise the Charter of Demands and implementation of the call for Human Chain on 25th November 2009.

Dear Comrade,
The meeting of Confederation of Central Government Employees and Workers New Delhi held on 13th September 2009 has decided to have the National Executive meeting of the Confederation of Central Government Employees on 4th to 6th December 2009 at New Delhi.

The meeting has asked the affiliates to declare its staff strength in respective units, as such the affiliates are requested to furnish the respective staff strength in Karnataka State to be presented to Confederation.

The COC on its part has to pay Rs 5000/- as subscription to Confederation, All affiliates are requested to clear the payment of the COC subscription for the year 2008 and 2009 years at the rate of Rs 2/- per member at the earliest and also special contributions for COC at Rs 20/ per member (if not paid earlier). So that the COC will be financially sound to take up various Confederation programs in coming months and early next year and also clear Confederation dues.

The next meeting of COC is likely to be held in October 2nd week, we are waiting for confirmation of Com M.S.Raja Secretary of Confederation of Central Government Employees program who is likely to address the COC meeting. The next COC meeting shall finalise the agenda to be placed for National Executive meeting of the Confederation.

This is bring to your kind knowledge after merger of pay scales pertaining to Rs 5000- 8000, Rs 5500-9000 & Rs 6500-10,500 into a single Grade pay of Rs 4200, The many departments are issuing promotions in the same grade pay example earlier an Assistant was in the pay scale Rs 5000- 8000 and Office Supdt. was in the pay scale Rs 5500-9000 now also these post have not been merged after 6th CPC instead all most in all Departments including Income tax dept. promotions are taking place from Assistant to Supdt. in the same grade pay. after promotion since it carries no financial up gradation of pay structure that is grade pay remains the same they have been denied the additional increment on promotion. where as on promotion they have to discharge higher responsibility.

Please take this matter either to merge the post pertaining to grade pay of Rs 4200 or grant additional increment on promotion.

As communicated vide this Department's Resolution No.l/l/2008-IC
dated 29th August, 2008, the Government had decided that the arrears on
account of implementation of Sixth Central Pay Commission's recommendations
will be paid in cash in two instalments - first instalment of 40% during the year
2008-09 and the remaining 60% in the financial year 2009-10. The first instalment
bas already been paid in 2008-09. It has now been decided that the remaining
60CJo of arrears may now be paid to the concerned Government servants.
J Further, as already stipulated vide this Department's O.M. No
-j (2)/ EV/2008 dated 17th August, 2009, in the case of post-Ol.01.2004 entrants
into the Central Government, the second instalment of arrears may be released
only after individual application forms for registration to the New Pension
Scheme have been obtained by the DDO/PAO from the concerned Government
servant.
3. As in the case of the first instalment of arrears, Government servants will
be permitted to deposit their arrears in their GPF Accounts. Though not
mandated, Government servants are encouraged to deposit their arrears in their
GPF accounts.

OFFICE MEMORANDUM

Subject:- Payment of second instalment of arrears on account of pay revision of employee of Quasi-Government Organisations, Autonomous Organisations, and Statutory Bodies, etc. set up by and funded/controlled by the Central Government.


The undersigned is directed to refer to this Department's orders issued under Office Memorandum of even number dated 30th September 2008 and 7th October 2008 extending the revised pay structure for the Central Government employees on the basis of the recommendation of the 6th Central Pay Commission to the employees of Autonomous Organization, etc whose pattern of emolument structure i.e.pay sacles and allowances(in particular the Dearness Allowance, the House Rent Allowance and City Compensatory Allowance) were identical to those of the Central Government employees.

2. AS per this Department's resolution No.1/1/2008-IC dated 29th August 2008, the Government had decided that the arrears on account of implementation of 6th CPC recommendation will be paid in cash in two instalments - first instalment of 40% during the year 2008-09 and the remaining 60% in the financial year 2009-10. Orders have since been issued by the Government for payment of remaining 60% of arrears to the concerned Central Government servants. Accordingly, the dicision of the Government for payment of remaining 60% of arrears is hereby extended to the employees of the Autonomous Organisations etc. Howerer, the payment of remaining 60% of arrears will be subject to the conditions stipulated budgetary support for additional expenditure vide para 4 and 4.1 of this Department's Office Memorandum of even number dated 30th September, 2008 at the time of extending the revised pay structure for the Central Government Employees to the employees of Autonomous Oraganisations etc.

BONUS orders

OFFICE MEMORANDUM

Subject:- Grant of Non-Productivity Linked Bonus (Ad-hoc bonus ) to Central Government Employees for the year 2008-2009.

The under signed is directed to convey the sanction of the President to the grant of Non-Productivity Linked Bonus
(Ad-hoc bonus ) equivalent to 30 days emoluments for the year 2008-2009 to the Central Government Employees in Group C
and D and all non-gazetted employees in Group B, who are not covered by any Productivity Linked Bonus Scheme.
The Calculation ceiling of Rs.3500/- remain unchanged. The payment will also be admissible to the Central Police
and Para-military Personnel and Personnel of Armed Forces. The orders will be deemed to extended to the employees
of Union Territory Administration which follow the other bonus or ex-gratia scheme.





2. The benefit will be admissible subject to the following terms and conditions:-
(i) Only those employees who were in service on 31.3.2009 and have rendered at least six months of continuous
service during the year 2008-2009 will be eligible for payment under these orders. Pro-rata payment will be
admissible to the eligible employees for period of continuous service during the year from six months to a full year,
the eligibility period being taken in terms of number of months service (rounded off to the nearest number of months)



(ii)The quantum of Non-PLB (Ad-hoc bonus) will be worked out on the basis of average emoluments/calculation
ceiling which ever is lower.To calculate Non-PLB(Ad-hoc bonus)for one day ,the average emoluments in a year
will be divided by 30.4(average number of days in a month)This will there after be multiplied by the number of
days bonus granted. To illustrate, taking the calculation ceiling of Rs. 3500/-(where actual average emoluments
exceed Rs. 3500X30/30.4=Rs. 3453.95 (rounded off to Rs.3454/-)



(iii)The casual labour who have worked in offices following a 6 days week for at least 240 days for 3 years or
more (206 days in each year for 3 years or more in the case of offices observing 5 days week ) be eligible for
this Non-PLB (Ad-hoc bonus) payment. The amount of Non-PLB (Ad-hoc bonus) payable will be Rs.1200x30/30.4 i.e.Rs.1184.21
(rounded off to Rs.1184/-) Incases where the actual emoluments fall below Rs.1200/-p.m.,the amount will be calculated on
actual monthly emoluments.



(iv) All payments under these orders will be rounded off to the nearest rupee.




(v)The clarificatory orders issued vide this Ministry’s OM No.F.14(10)-ECooRD/88 dated 4.10.1988, as amended
from time to time, would hold good.



3. The expenditure on this account will be debitable to the respective Heads to which the pay and allowances
of these employees are debited.



4. The expenditure on account of Non-PLB (Ad-hoc bonus) is to be met from with in the sanctioned budget provision
of concerned Ministries /Departments for the current year.



5.In so for as the persons serving in the Indian Audit and Accounts Department are concerned , these orders are issued
in consultation with the Comptroller and Auditor General of India.

AGENDA for COC meeting
Dear Comrades

Anomaly and Standing Committee meetings.
There had been no formal or informal meeting with the Government either to discuss the anomalies or issues emanating from the implementation of the 6th CPC so far. We had placed the items the staff side had sent for the consideration of the National anomaly committee (first installment) on our website. The second and final set of items is likely to be submitted in a day or two. As and when the same is finalized we shall place copy thereof on our website. We have received innumerable number of letters from our affiliates requesting us to take up the department specific anomaly items in the National Council. It is difficult to individually respond to these letters. Department specific items are to be pursued at the Departmental Anomaly Committees. Complaints have been received by us that many Ministries have so far not set up anomaly committees. We shall take up this issue with the Department of Personnel.

National Council meeting.

The National Council of the Confederation is due to be held in this month as indicated in our last communication. The available members of the National Secretariat of the Confederation met at New Delhi and it has been decided to convene the Council meeting either by the end of November, 2009 or in the first week of December, 2009 as per the availability of the hall etc The Council meeting will be held at New Delhi.

All India Convention of workers: 14th September, 2009.


The Sponsoring Committee of Central Trade Unions along with INTUC and BMS has decided to convene a National Convention on14th September, 2009. The main theme of the convention is to harness the support of the entire working class in the country against the neo liberal economic policies and the anti labour attitude of the Government. The extract from the communication we have received in this regard is given hereunder.
The meeting of the Central Trade Unions held on 19th July, 2009 at the INTUC H.qrs. at New Delhi expressed serious concern over;
*rising prices of essential commodities including food grains and vegetable creating severe hardship for the mass of the people
*continuing job losses resulting in loss of livelihood to millions of workers across the sectors owing to recession and economic slowdown
*non implementation of and rampant violation of basic labour laws pertaining to minimum wages, working hours, social security safety in workplace and trade union rights etc. throughout the country adding to the sufferings of the entire toiling people
*move of the Government for disinvestment of shares in profit making central public sector enterprises

The Central Trade Unions call upon the workers and employees and their unions irrespective of affiliation to unitedly highlight the concern over the above mentioned burning issues facing them and at the same time urge upon the Government to take urgent remedial corrective measures to address the aforesaid concerns of working people effectively.
The Central Trade Union decides to submit a memorandum to the Prime Minister on the aforesaid issues and hold a National convention of Trade Unions at Delhi in September, 2009 to chalk out common future programme.

60% PAY COMMISSION ARREARS FOR CG EMPLOYEES IN SEPTEMBER

The leaders of Confederation had interacted with the Finance Secretary on the issue of payment of 60% balance arrears of pay commission - We were told that the payment will be ordered only in the month of September 2009 when one year period will be completed from payment of 40% arrears last year. Though funds have been allotted in the Budget, the payment orders will be only next month.


CGHS:

The Government is moving ahead with the introduction of Health Insurance Scheme in lieu of CGHS in a big way. This stand is the fall out of the recommendations of the 6th CPC for introducing such a medical insurance scheme. The Ministry of Health & Family Welfare has called for Expression of Interest from Health Insurers / Health Insurance Consultants by providing the following information.

Confederation of Central Government Employees has taken a position that strengthening of CGHS will be the better option instead of going for such Health Insurance Schemes. The stand of the Government is a fall out of the neo-liberalization policy under which the State is withdrawing more and more from its commitment towards providing health services.

OUTSOURCING OF DATA ENTRY WORK RELATED TO BOOKING OF BULK SPEED POST ARTICLES.

Department of Posts has ordered outsourcing of data entry work related to booking of speed post articles w.e.f. 1st September 2009.

Indian Audit and Accounts Department: Expression of Interest

Appointment of a Consultant to conduct a work-study to redefine/established work norms relevant in the current context for optimized staffing of Group ‘B’ & ‘C’ cadres in Indian Audit and Accounts Department and thus arrive at a continuing scientific framework to estimate manpower requirement for various types of audit/ accounting work in the changing environment


The existing work norms, crucial for assessing manpower needs for both audit and accounts and entitlement offices, are very old. There have been rapid changes in the work environment over the past couple of decades such as automation of certain government functions, increased role of public private partnership model, increase in regulatory functions, e-governance, and changes in public funding of major programmes and schemes, etc. As a result, the existing work norms have become outdated and are no longer comprehensive enough to be of much use in determining optimal strength of the Department.

Sub: Filling up of vacant posts in Central Government.
Sir,
In Central Government there are 9.7 lakhs posts are laying vacant due to non filling of these posts since May 2001, Which has resulted in burdening of existing employees and also the Central Government machinery is unable to function in full swing as 30% of the posts are not filled up. There are many unemployed youths in the country by filling up these posts Central Government could have given job opportunity to these unemployed youths. Which would have resulted in better functioning of Central Government with more revenue collection from revenue earning departments like Income Tax, Central Excise etc as there are many tax evaders in the country but due to shortage of staff the Revenue dept’s are unable to function.
In May 2001 the Government issued instructions withdrawing the authority from the concerned Heads of Department to fill up the vacant posts through recruitment and assigning the same to a Screening Committee. As per the stipulation the said screening committee is entitled to authorize filling up only 1/3rd of the direct recruit vacancies ( subject to a maximum of 1 % of the sanctioned posts), the rest 2/3rdbeing abolished permanently. The intention of the order was to reduce the existing manpower drastically. No post was allowed to be created even for justified functional requirement.





Not only it killed the job opportunities for thousands of unemployed youth in the country, but also in the process crippled the functioning of the Departments raising the burden of workload on employees. Even though the said instruction was prima facie applicable to all cadres, categories and groups of civil servants, the Group A Cadres has invariably been excluded by almost all the Departmental Heads. In other words, the abolition of posts had only been in Group C and Group D Cadre only.
The Central Government has lifted these Ban on recruitment in April 2009 but with a condition not to fill up back log posts. There are many operational posts in various depts. Which are vital in nature The Government should fill up these posts immediately so that functioning of the Depts. Will not be affected.The strength of Central Government has reduced from 40 lakhs in the year 2001 to 30 lakhs in 2009, I request your kind self to publish this report in your esteemed newspaper in public interest.

The undersigned is directed to refer to the above-cited subject and to say that vide this departments O.M.No 2/8/2001-PIC dated 16th May 2001, the Scheme of Optimization of Direct Recruitment to Civilian Posts was introduced for five years with the objective of rationalization of the manpower in various Ministries / Departments of the Government of India. As per the Optimization Scheme, all Ministries / Departments were mandated to prepare the Annual Direct Recruitment Plan for each year in order to prioritize the fresh intake of manpower. After the expiry of the initial five years period, the Optimisation Scheme was reviewed in the year 2006 in consultation with the Department of Expenditure, Ministry of Finance and it was decided to extend the scheme for a further period of three years i.e., up to 31st March 2009 subject to a review after the receipt of the recommendations of the Sixth Central Pay Commission.

2. In this regard, the Sixth Central Pay Commission has recommended, "multiskilling of the Government employees which would increase their operational efficiency while simultaneously optimizing the staff strength. It is however, noted that while rightsizing in Government is necessary given the changes in the work process due to technology and consequent reduction of layers, a blanket ban on filling up of vacant posts across the board can impact effective functioning. More flexibility is required in this policy for effective service delivery and care has to be taken that administrative delivery structures do not become hollow or thin in critical areas ". (Para 6.3.10)

3. Keeping in view the above recommendation of the Sixth Central Pay Commission, the optimisation policy has again been reviewed in consultation with the Department of Expenditure, Ministry of Finance and it has been decided not to extend the validity of the Optimization Scheme beyond 31.3.2009.

meeting of the Confederation.



This meeting of the National Executive of the Confederation of Central Government employees and workers held at New Delhi on 2nd April, 2009 drew satisfaction from the response of the Central Government employees to the appeal made by it on 24th March, 2004 to mount vigorous campaign amongst the mass of the employees to take a decisive stand against the then Government at the general election in 2004. With the sustained efforts and endeavour of the entire working class in the country a combination of those political parties who are opposed to fundamentalist and communal forces could be brought to power after the general elections in 2004 in the country. Such a combination of the political parties thus took over the reins of the country with the support extended by the left parties from outside on the clear understanding that the cardinal principle of governance would be what was agreed upon by all concerned as the National Common Minimum programme.



The present Govt. at the beginning kindled the hope and aspiration of the common multitude of the country especially the working class. However once in power the Prime Minister and the Finance Minister unmindful of the strident opposition of the organized movement of the working class and disregarding the views of the Left Parties pursued the same discredited neo-liberal economic policies. The sponsoring committee of Trade Union organizations had to perforce tread the path of struggle and organize strike actions in 2006, 2007 and 2008 to compel the Government to reverse its economic policies of liberalization and globalization. The ban on recruitment which was imposed by the NDA Govt. in 2001 through an executive fiat was not only not withdrawn but continued; many Government departments were wound up; public enterprises were privatized; FDI was allowed in many sectors including the sensitive and strategic ones; initiated policy shifts making higher and professional education beyond the reach of the common man; service tax net was widened to cover many areas of concern to common man; various concessions and exemptions from taxation were provided to the rich and corporate bodies; subsidies were withdrawn driving peasants to penury; the only tax deduction available for the salaried employees i.e the standard deduction under section 16 of the I.T.Act was withdrawn; capital gains tax on stock transactions was abolished to give impetus to speculative business at terrible cost to exchequer; allowed future trading on consumable food articles which became the primary cause for the escalation of prices of all essential commodities like rice, wheat, dhal, edible oil vegetable, sugar etc.; allowed the monopoly houses to enter the retail trade rendering thousands jobless; indulged in massive downsizing and outsourcing of the Governmental functions; raised the administrative price of petroleum products; proposed full capital convertibility of rupee; created innumerable special economic zones granting power to hire and fire to the entrepreneurs; persisted with the financial sector reforms unmindful of the global economic recession; introduced bill to withdraw the labour welfare enactments; did everything to integrate Indian economy to the vagaries and dangers of globalization; weakened and almost wound up the public distribution system; all this done in contravention of the agreed National Common Minimum programme.



At the instance of the proponents of the free market economy and with a view to boost the stock market operations the Government decided to privatize the pension funds and do away with the age old statutory defined benefit pension scheme of the Government employees by introduction of the PFRDA bill in the Parliament. Almost all the State Governments barring Bengal, Tripura and Kerala followed this dictum and introduced the new contributory pension scheme. Despite the stiff opposition of the Central and State Government employees manifested unambiguously by a magnificent strike action on 30th October, 2007 jointly organized by the Confederation and the All India State Government employees Federation, the Government persisted with the PFRDA bill which however could not obtain the Parliamentary sanction due to the principled and consistent opposition of the Left parties. Still the Government put into operation the new contributory pension scheme in fact illegally and unethically through executive instructions. At the fag end of its tenure it decided to divert the pension funds to stock market to boost up the falling sensex.

No different was its attitude towards the employees in the matter of implementation of the 6th CPC report. The report itself was to perpetuate the wage differential between the top echelons of the bureaucracy and the employees. The Government's decision was to accentuate this ill advised recommendation further as it chose to accept the suggestion of the Committee of Secretaries to further increase the Grade pay of all Group A officers and reject the demand of the employees for a fitment formula to provide a minimum benefit of 40% rise in emoluments to all employees. It refused to grant the minimum wage as per the 15th ILC norms and refused to negotiate the recommendations of the 6th CPC with the employees' representatives. It also decided to do away with 9 lakhs Group D posts and outsource all Group D functions to private contractors. On the question of wage revision of 3.5 lakhs Grameen Dak Sewaks, the Government took initially an extremely nugatory attitude by not setting up a judicial committee for their wage revision and later by not revising their wages. Same was the attitude of this Government towards the temporary and casual workers. While the regular employees were given the benefit of wage revision, the casual and daily rated workers were denied. Even after issuing orders for the grant of Child care leave for women employees as per the recommendation of the 6th CPC, the Govt. later issued a clarificatory order virtually denying this benefit. In the case of pre-1996 pensioners the benefit of fixation on notional pay basis was denied. Even in the face of the impact of the world economic recession, it refused to lift the ban on recruitment, fill up the large number of existing vacancies or take steps to generate employment as demanded unanimously by the entire trade union movement in the country in the recently concluded Indian Labour Conference

During the five year tenure, it discarded India's independent foreign policy and moved away from the time tested non-aligned movement. It compromised the country's independent nuclear technology development programme by entering into a controversial agreement which became the subject matter of severe criticism from various quarters. While this had been the track record of the present Government, the major constituent of the opposition had been indulging throughout this period to foment social disharmony, to spread hatred and to fracture the secular social fabric providing impetus to the growth of terrorism.

In this background the National Executive appeals all affiliates and COCs to campaign amongst the mass of the employees and the people of the country to vote for those candidates who support the cause of the working class in general and Government employees in particular. The meeting calls upon all concerned to organize state/district level conventions and mass meeting in front of all offices to organize the employees for this purpose.

Confederation Meeting Minutes

We send herewith the resolution adopted at the National Executive of the Confederation, which met today at New Delhi. Kindly publish the same in your journal and circulate it amongst the employees. We should organize meetings in front of all offices and convey to the members that the ACP orders are not likely to be issued before the election and the Government has not acceded to the demand of the Staff Side to continue the existing practice of effecting ACP on the basis of department specific hierarchical set up. The grant of second installment of arrears of 6th CPC dues is also likely to be delayed and may not be released before August, 2009. The meeting was apprised of the items finalized and forwarded to the National Anomaly Committee. The next meeting of the National Executive will be held in June, 2009. All affiliates are requested to clear the outstanding subscription dues and the special contribution of Rs. 20 per member by 30th May, 2009. The National Conference (the triennial conference) is due in September, 2009. Since the accounts are to be finalized and audited latest by 10th August, 2009, the due date indicated for remittance of dues may please be adhered to.
