The date of effect of allowances.

Comrades,
        The Central Government employees are always be cheated in respect of date of implementation of allowances especially on HRA , from past twenty years it is observed that these allowances are issued from a later date in 5th CPC case it was issued after 20 months , in case of 6th CPC it was issued after 32 months  , in 7th CPC we hoped it will be issued in 7 months , but it was not the case , now it is likely to be issued only after 11 months . There by causing financial loss to the employees, the cost of living index is going up every month, but the allowances especially the HRA is not issued from the date of effect of the pay commission.

The following are the facts :              
 The Fifth Central Pay Commission was set up by the Government of India by Resolution No. 5(12)/E. III/93 dated 9th April, 1994.  The Commission submitted on the 30th January, 1997. The revised allowances, other than dearness allowance, was  effective from 1st day of August, 1997 instead of 1st January 1996. 

 The Government constituted the Sixth Central Pay Commission vide Resolution No. 5/2/2006-E.III(A) dated October 5, 2006. and Gazette Notification for implementation of 6th CPC was issued on 29th August 2008, all allowances were issued effective from 1st August 2008 instead of 1st January 2006.

In a resolution dated 28th February, 2014, Government of India has appointed the Seventh Central Pay Commission. The Gazette Notification for implementation of 7th CPC was issued on 25th July 2016 (without allowances) , all allowances are likely to be issued from 1st December 2016 instead of instead of 1st January 2016 after a committee headed by the Finance Secretary gives its report .

The present HRA and other allowances as per 6th CPC is totally insufficient, the cost of housing has gone up drastically and cost of living has gone up hence urgent need to revise the HRA and other allowances , we hope the Government to review the allowances at the earliest, so that the Central Government employees will get the enhanced allowances especially HRA from 1st July 2016 as per earlier practices.

REPLY OF THE FINANCE MINISTER IN RAJYA SABHA

Dear Comrades,

We are reproducing below the reply given by the Hon’ble Finance Minister Shri Arun Jaitley in the Rajya Sabha on 19-07-2016 --

The Finance Minister has made it clear that the government is responsive to the concerns of the Employees’ Associations and it would be the endeavor of the Government to ensure that the eventuality of a strike does not arise.”

Regarding increasing of the multiplication factor, the Finance Minister replied that:

“no such proposal is under consideration of the Government, at present

The assurance given to the NJCA leaders by the Group of Ministers (including Finance Minister) on 30-06-2016 is that enhancement in minimum pay and fitment factor (multiplication factor) will be considered favourably by the Government, once the proposal in this regard is submitted to Government by the proposed “High Level Committee” within four months. Hence, the matter will come for the  “consideration” of the Govt. only after submission of the report by the High Level Committee.

In that sense, technically, the reply of the Finance Minister that “at present” there is no such proposal under consideration of the Government, may not be taken in a different manner and we need not jump into the conclusion that multiplication factor will not be increased.

However, giving due importance to the concerns expressed by many of our comrades and grass-root level leaders, the NJCA will discuss this issue shortly and take appropriate decision. NJCA is keenly observing the move of the Govt. and any going back from the assurances given by the Group of Ministers or any betrayal of 33 lakhs Central Govt. Employees and 40 lakhs pensioners by the NDA Govt., shall result in revival of the deferred strike by the NJCA and Government will be solely responsible for all consequences.

Will the Minister of FINANCE be pleased to satate :-
(a) whether Government has implemented the 7th Central Pay Commission recommendations;
(b) if so, the details thereof along with the date of notification thereof;
(c) whether increase in pay of Central Government Officials is historically low under 7th CPC; if so, the reasons thereof;
(d) whether employees unions/trade unions have announced to go on indefinite strike against the historically low revision of salaries by Government, if so, the response of Government thereto; and
(e) whether uniform multiplication factor of at least 3 is proposed to be applied for revision of pay under 7th CPC; if not, the reasons therefor?

(a) & (b): The Government has decided to implement the recommendations of the 7th Central Pay Commission relating to pay, pension and related issues. The requisite notifications are being issued shortly.
(c) The increase in pay as recommended by the 7th Central Pay commission is based on the detailed deliberations by the Commission keeping in view all relevant factors having a bearing upon the prevailing circumstances

.
(d) Employee Associations of Central Government had given a call for strike with effect from 11.07.2016 which has since been deferred. However, the Government is responsive to the concerns of the Employees’ Association and it would be the endeavour of the Government to ensure that the eventuality of a strike does not arise.

(e) In view of the multiplication factor having been accepted based on the recommendations of the 7th Central Pay commission, no such proposal is under consideration of the Government, at present.

Gazette Notification for implementation of 7th CPC

Comrades,
 There are lot of discussions about the date of Gazette Notification for implementation of 7th CPC & Office Memorandum, It usually takes about 15 to 20 days after cabinet approval of the pay commission report .Let us examine the 6th CPC dates.
The union cabinet gave its approval for implementation of the recommendations of the Sixth Central Pay Commission on 14th August 2008.
 Gazette Notification for implementation of 6th CPC was issued on 29th August 2008  & Office Memorandum was issued on 30th August 2008, after 16 days after cabinet approval
The 7th CPC
The union cabinet gave its approval for implementation of the recommendations of the Seventh Central Pay Commission on 29th June 2016.
Hence the Gazette Notification for implementation of 7th CPC & Office Memorandum is likely issued in next week.

NJCA Defers Strike on the face of Government Assuring Consideration of Staff Side Views

NJCA UNANIMOUSLY RESOLVES TO DEFER THE INDEFINITE STRIKE


Comrades
                After the meeting with the Home Minister today by the NJCA and further developments leading to issue of a Press Release by the Government of India assuring consideration of the issues raised by the Staff Side relating to the pay scales and other recommendations of the Pay Commission by a High Level Committee, the NJCA has decided to defer the Indefinite Strike in the background of meetings with the Ministers and the assurance by the Government of India.

The COC Karnataka thanks all affiliates for their timely effort in mobilizing members for 11th July strike.  We sincerely hope the High Level Committee will have a serious view of the grievances of the Staff Side in  respect of  7th CPC  issues. The COC Karnataka will strive for resolving the issues through the Staff Side JCM.  I once again thank one and all their kind effort in mobilization  members for 11th July strike.  I hope you will extend the  same co-operation in the coming days.

Finance Minister Press Statement

Government assures Representatives of Unions representing employees of the Central Government that the issues raised by them relating to the pay scales and other recommendations of the 7th Pay Commission would be considered by a High Level Committee

Representatives of Unions representing employees of the Central Government had met the Home Minister Shri Rajnath Singh, the Finance Minister Shri Arun Jaitley and the Minister for Railways Sh. Suresh Prabhu in the evening of 30th June, 2016.

They had requested that certain issues raised by them in relation to the pay scales and other recommendations of the Pay Commission be allowed to be raised before a Committee of Secretaries looking into different aspects of grievances of employees in relation to the Pay Commission recommendations.

The Ministers assured the Union leaders that the issues raised by them would be considered by a High Level Committee. 

NJCA Meeting on 11th JULY strike

The National Joint Council of Action (NJCA) met at the Staff Side office, JCM, New Delhi today at 11:30 AM as scheduled. During the discussions, the Convener received an invitation from the Honourable Home Minister, Shri Rajnath Singh. The following members of the NJCA met the Home Minister in a delegation.

Giriraj Singh (NFPE), 15. Satish Chander (FNPO), 16. Shiv Kumar (FNPO), 17. N. Kannaiah (AIRF).
The issues in the Charter of demands were discussed with special reference to the 7th CPC related demands. The delegation brought to the notice of the Honourable Home Minister that the NJCA has not received a communication from the Government over the assurances held out on 30th June, 2016, when the NJCA delegation met the Honourable Home Minister, Finance Minister and the Railway Ministers. On 30th June 2016, the Government had assured to refer the revision of Minimum wage and fitment formula to a Committee. The Finance Minister has also clarified that the Government has taken the decision to implement the recommendation of the 7th CPC to bring about parity between the past and present pensioners. They added that such a communication in confirmation of the assurances will enable them to take a decision over the strike action which is to commence from 11th July, 2016.
The Honourable Home Minister assured the delegation that the Government will honour the assurances held out to the NJCA leaders on 30th June, 2016 and accordingly the Honourable Finance Minister,Shri Arun Jaitly will issue a Press Statement today, with copy to NJCA.
After receipt of the copy of the Press Communique issued by the Honourable Finance Minister, the NJCA will take a final decision.

The All-India CPI-IW for May, 2016 increased by 4 points and pegged at 275 (two hundred and seventy five). On 1-month percentage change, it increased by (+) 1.48 per cent between April, 2016 and May, 2016 when compared with the increase of (+) 0.78 per cent between the same two months a year ago.
